Bellevue Fee Simple at Planning Commission on Sept. 23

After many meetings and discussions with Bellevue staff and elected officials, MBAKS has received drafts of the potential Land Use Code Amendments, including a fee simple overlay for townhomes. This batch includes three proposals:

  1. Unit Lot Subdivisions. The unit lot subdivision process provides opportunities for fee simple ownership of land as an alternative to condominium ownership. We have two versions, the “clean” copy and the mark-up copy, with comments on the components of the proposed regulations. The draft amendment should begin public hearings in the late summer.

    A few things to note for this draft are:
    • The ULS would be processed concurrently with a preliminary subdivision or preliminary short subdivision application.
    • Approval will be based compliance with the existing preliminary plat or short plat decision criteria.
    • It would only apply to Attached Multifamily Dwelling Units (townhouses).
    • Staff is working on a checklist that identifies minimum application elements necessary to review a unit lot subdivision proposal.

  2. Accessory Dwelling Units. The ADU draft amendment allows attached ADUs at the time of building construction by removing the existing building (3-year) requirement.

  3. Reduced Residential Minimum Parking Standards Near Frequent Transit. The city adopted an Interim Official Control ordinance and mapped the areas believed to be eligible. This ordinance reduces the minimum parking requirements for certain residential uses when they are located within 1/4 mile of a transit stop with frequent transit. The city’s next step will be to develop permanent regulations over the next few months.
