GMHB Invalidates Latest Sammamish Moratorium—Seeks Sanctions

The Growth Management Hearings Board (Board) last week invalidated the city of Sammamish’s April 2021 concurrency moratorium. This is the third invalidation order the Board has issued to the city since 2019. The Board accompanied its decision with a letter to Governor Inslee urging he impose sanctions to prevent the City’s intransigence toward the Growth Management Act (GMA)—and the Board’s authority to enforce it—from being normalized. The city has not adopted any legislation since this decision. Note, however, there is a moratorium in effect covering a portion of the city that falls within the Sammamish Plateau Water and Sewer District. Project proponents are encouraged to speak with their land use counsel about specific submittal questions.
