Court of Appeals Decision in Favor of Statutory Vested Rights

Your Association has actively participated as amicus curiae in an appeal regarding the Issaquah Highlands Development Agreement which raises questions related to vesting, how development agreements should be treated, and a developer/applicant’s rights during the process of terminating a development agreement and replacing applicable regulations. The Court of Appeals, Division 1, has agreed with the developer/appellant and the Association’s arguments – you can read the decision here. The Association and developer have moved the Court to publish the decision as being well written and clarifying the law in favor of statutory vested rights and the enforceability of development agreements.
